Terms of Service

The Service is strictly limited to adults. You may use the Service only if you are at least 18 years of age, or the age of majority in your jurisdiction if that age is higher. Every visitor must confirm that they meet this requirement before any content is displayed, and every registered user must confirm it again at sign-up.

The Service produces fictional written material intended for a mature audience, which may include sexual themes. It is not suitable for minors. If you are responsible for a minor who has access to your device, you are responsible for preventing that access. We will terminate, without notice and without refund, any account we believe to be held by a person under 18.

NyxAI is a text-only creative writing tool. You supply a premise, characters and stylistic settings; the Service uses third-party large language models to generate a work of fiction in response. The Service does not host, produce or distribute photographic or video material, and does not feature real performers.

Access is sold as prepaid word credits. We may modify, suspend or discontinue any part of the Service; where a change materially reduces what you have already paid for, the Refund Policy applies.

All characters depicted in any sexual context must be adults aged 18 or over, and must be fictional. The following are strictly prohibited, both as input you submit and as output you attempt to obtain, publish or distribute through the Service:

• any sexual content involving a minor, or involving a character who is described, implied or depicted as being under 18, including school-age settings used to imply minority;
• content that sexualises real, identifiable individuals, including public figures;
• content depicting or promoting bestiality, necrophilia, or defecation;
• content depicting rape or simulated rape;
• content presenting non-consensual sexual activity, trafficking or sexual violence as real, endorsed, instructional or desirable;
• content that is unlawful, defamatory, harassing, or that promotes terrorism, self-harm or violence against any person or group;
• infringement of another party’s copyright, trade mark or other rights;
• fraud, phishing, unauthorised access to our systems or to other users’ accounts, circumvention of usage limits, or automated bulk access by bots or scrapers.

Enforcement. Prompts, character profiles and other user input are screened by automated filters before generation; requests that breach the list above are refused and the attempt is logged. Any work submitted to our public library is screened automatically a second time before it becomes publicly visible. Readers can flag a published work from the work’s own page, and removal requests can be sent to support@nyx-ai.net at any time; unlawful material is removed and the account terminated. We cooperate with law enforcement and will report suspected child sexual abuse material to the appropriate authorities.

Some features require a registered account with a verified email address. You are responsible for keeping your credentials secure and for all activity under your account.

Deleting your account. You may delete your account at any time from Settings, or by emailing support@nyx-ai.net from your registered address. Your account, your stories and your personal data will be deleted within seven (7) business days of the request. Transaction records that we are required by law to retain are kept for the period described in the Privacy Policy. Unused word credits are forfeited on deletion unless a refund is requested first.

We may suspend or terminate an account that breaches these Terms. Where the breach is Section 3, termination is immediate and no refund is given.

Word credits are a digital product. They are credited to your account immediately on successful payment and do not expire. Prices are shown at the point of purchase and include any applicable taxes unless stated otherwise. We do not store your card details; payment is handled by our payment service providers.

Unused word credits are refundable within 7 days of purchase. Full conditions, exclusions and the request procedure are set out in the Refund Policy, which forms part of these Terms. If you believe a charge is incorrect, please contact us at support@nyx-ai.net before raising a chargeback so that we can resolve it directly.

Your content. You retain ownership of the stories you generate. You grant us a non-exclusive, worldwide, royalty-free licence to store, process and display that content for the sole purpose of operating the Service — and, if you choose to publish a work, to display it to other users.

Our content. The design, text, graphics, logos and software of the Service are protected by copyright and trade mark law and may not be copied, modified or redistributed without permission.

Rights complaints. If you believe content on the Service infringes your rights, email support@nyx-ai.net with the URL, a description of the work and your contact details. We remove infringing material promptly on verification.

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

AI-generated text may be inaccurate, incomplete or biased. It is fiction and must not be relied on as advice of any kind. You are responsible for how you use it.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, data or goodwill, even if advised of the possibility. Our total aggregate liability arising out of or in connection with the Service is limited to the amount you paid us in the twelve months preceding the event giving rise to the claim.

These Terms are governed by the laws of the Hong Kong Special Administrative Region. The parties will first attempt to resolve any dispute in good faith; failing that, the courts of Hong Kong SAR shall have jurisdiction.

We may revise these Terms from time to time. The revised version will be posted here with an updated date, and material changes will be notified by an appropriate means. Continued use of the Service after the effective date constitutes acceptance.
